Terms of Service
These Terms of Service govern access to and use of Homios websites, mobile applications, and related scheduling, messaging, marketing, analytics, and customer management services for home service and house call businesses. By creating an account, downloading our mobile app, accessing our website, or using any Homios service, you agree to these Terms.
1. Eligibility and Authority
You may use Homios only if you are at least 18 years old and legally able to enter into a binding contract. If you use Homios on behalf of a business or other organization, you represent that you have authority to bind that entity to these Terms.
2. Services Covered by These Terms
Homios offers software and related tools through web browsers, mobile applications, and connected integrations. The services may include appointment scheduling, dispatching, CRM functions, automated reminders, email or SMS communications, marketing workflows, analytics dashboards, payment-related integrations, and support resources. Some features may be available only on web or only on mobile.
3. Account Registration and Security
- You must provide accurate and current registration information.
- You are responsible for all activity under your account and for maintaining the confidentiality of your credentials.
- You must notify Homios promptly if you suspect unauthorized access or misuse of your account.
- You must use reasonable safeguards to protect devices used to access the Homios web platform or mobile app.
4. Customer Data and Business Content
You may upload or submit customer contact information, appointment details, notes, communications, marketing content, and other business records through Homios. You retain ownership of your content. You grant Homios a limited right to host, process, transmit, and display that content solely as necessary to provide, secure, support, and improve the services, and to comply with law.
You are responsible for ensuring that you have all rights, notices, and consents required to collect, use, message, email, or otherwise process customer information through Homios, including where required by laws governing privacy, telemarketing, email marketing, or consumer protection.
5. Acceptable Use
You may not use Homios to:
- Violate any applicable law, regulation, or third-party right.
- Send unlawful spam, deceptive marketing, or messages without required consent.
- Upload malicious code, interfere with service security, or attempt unauthorized access.
- Scrape, reverse engineer, copy, or resell the services except as allowed by law.
- Use the services in a way that threatens system stability, customer trust, or platform integrity.
6. Messaging, Email, and Notifications
Homios may enable appointment reminders, marketing campaigns, transactional emails, and SMS or push notifications. You are solely responsible for determining whether you have the notices and consent needed to send communications to your end customers. You must comply with applicable laws and guidance, including, where relevant, the CAN-SPAM Act, Telephone Consumer Protection Act, state privacy laws, and carrier or platform requirements.
7. Mobile App Terms
If you download or use a Homios mobile application, you also agree to the following:
- The app is licensed, not sold, to you for use on compatible devices you own or control.
- You may use the app only in accordance with these Terms and any applicable usage rules from Apple App Store or Google Play.
- Apple and Google are not responsible for providing the Homios services, maintenance, support, or warranty obligations except as required under their own policies.
- You must maintain a compatible device, operating system, and internet connection to use mobile app features.
- Certain mobile features may rely on permissions such as notifications, camera access, contacts, or location, which you may manage through your device settings.
8. Fees, Billing, and Trials
Paid features may require a subscription or other fees. Unless otherwise stated in an order form or checkout flow, fees are billed in advance, are non-refundable except as required by law, and automatically renew until canceled. You authorize Homios and its payment processors to charge the applicable payment method for recurring fees, taxes, and permitted overages.
9. Third-Party Services
Homios may integrate with third-party tools such as payment processors, calendar providers, messaging services, analytics vendors, cloud infrastructure providers, or app store services. Homios is not responsible for third-party services, and your use of those services may be subject to separate terms and privacy policies.
10. Intellectual Property
Homios and its licensors own all rights, title, and interest in the services, including software, design, content, trademarks, and documentation, excluding customer content. Subject to these Terms, Homios grants you a limited, non-exclusive, non-transferable, revocable right to use the services for your internal business purposes.
11. Suspension and Termination
Homios may suspend or terminate access if we reasonably believe you violated these Terms, created legal or security risk, failed to pay amounts due, or used the services in a way that harms Homios, users, or third parties. You may stop using the services at any time. Sections that by their nature should survive termination will survive, including sections regarding payment obligations, intellectual property, disclaimers, limitations of liability, and dispute terms.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the services are provided on an "as is" and "as available" basis. Homios disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Homios does not guarantee uninterrupted operation, error-free performance, or that the services will meet every business, regulatory, or technical requirement.
13. Limitation of Liability
To the fullest extent permitted by law, Homios and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities, arising out of or related to the services or these Terms. Homios's total liability for all claims arising out of or relating to the services will not exceed the greater of the amounts you paid to Homios in the 12 months before the event giving rise to the claim or 100 U.S. dollars.
14. Indemnification
You will defend, indemnify, and hold harmless Homios and its affiliates, officers, employees, and agents from and against claims, losses, liabilities, damages, judgments, costs, and expenses arising out of your content, your misuse of the services, your communications with end customers, or your violation of these Terms or applicable law.
15. Governing Law and Disputes
These Terms are governed by the laws of the United States and, except where preempted, the laws of the State in which Homios maintains its principal place of business, without regard to conflict of laws rules. Any dispute not subject to applicable consumer law protections will be resolved in the state or federal courts located in that jurisdiction, and each party consents to venue and personal jurisdiction there.
16. Changes to These Terms
Homios may update these Terms from time to time. If we make material changes, we will post the revised version and update the effective date. Where required by law, we will provide additional notice. Continued use of the services after the updated Terms take effect means you accept the changes.
